Non-Solicitation: I understand that our clients, customers, and employees are valuable assets to the company. Therefore, I agree not to directly or indirectly solicit or entice any client, customer, or employee of the company for personal or competitive purposes during my employment and for a specified period after termination. Intellectual Property Rights: Any inventions, discoveries, designs, software, or intellectual property created by me during the course of my employment shall be the exclusive property of the company. I understand that all intellectual property rights arising from my work will be assigned to the company, and I waive any rights or claims to such property. Reporting and Accountability: I commit to providing regular reports on the progress of my work to my superiors or designated managers. I will update them on the status, challenges, and achievements related to my assigned tasks, ensuring open and transparent communication. Duty of Loyalty: I will be loyal to the company and its goals, working diligently and ethically to advance its interests. I will refrain from engaging in activities that may harm the company's reputation, including disparaging remarks or actions that may undermine the company's success or public image. Conflict of Interest: I will disclose any potential or actual conflicts of interest that may arise during my employment. This includes personal relationships, financial interests, or outside activities that could influence or compromise my objectivity and loyalty to the company. Compliance with Policies and Regulations: I will familiarize myself with and adhere to all company policies, guidelines, and applicable laws and regulations. I understand that failure to comply may result in disciplinary action, including termination of employment. Professional Conduct: I will conduct myself in a professional and respectful manner towards colleagues, clients, customers, and partners. I will refrain from engaging in discriminatory, harassing, or unethical behavior, promoting a positive and inclusive work environment. Termination of Employment: In the event of termination, I will return any company property, confidential information, or documents in my possession. I will cooperate in the transition of my duties and responsibilities to another employee, ensuring a smooth transfer of knowledge. Probationary Period: Upon commencement of employment, I understand that I will be subject to a probationary period of 7 days. During this time, both the company and I will have the opportunity to assess our compatibility and suitability for the role. The probationary period may be extended by mutual agreement between the company and myself. Performance Evaluation: Throughout the probationary period and during regular employment, I agree to participate in performance evaluations as scheduled by the company. These evaluations will be conducted to assess my job performance, provide constructive feedback, and discuss areas of improvement or further development. Training and Development: I acknowledge that the company may provide training and development opportunities to enhance my skills and knowledge. I agree to actively participate in such programs and apply the acquired knowledge to my work to improve job performance. Termination during Probation: In the event that either party determines that the employment relationship is not suitable during the probationary period, termination may occur with or without cause. In such cases, notice requirements will be in accordance with applicable laws and regulations. Confirmation of Employment: If the company determines that my performance during the probationary period is satisfactory, I will be confirmed as a permanent employee. Confirmation will be subject to the terms and conditions outlined in the employment contract or applicable policies. Extension of Probation: In certain circumstances, the company may extend the probationary period beyond the initial 10 days. The extension will be communicated to me in writing, specifying the reasons for the extension and the duration of the extended probationary period. Rights and Benefits: During the probationary period, I understand that my rights and benefits may be subject to certain limitations or exclusions as determined by the company. These may include entitlements to vacation leave, sick leave, or other benefits, which will be clarified in the company's policies or employment contract. Termination Notice Period: If either party wishes to terminate the employment contract after the probationary period, a notice period as specified in the employment contract or relevant legislation will apply. The notice period may differ depending on the length of service and the applicable laws of the jurisdiction. Confidentiality and Non-Disclosure (during probation): Even during the probationary period, I will uphold the obligations of confidentiality and non-disclosure as outlined in the terms and conditions above. Modification of Terms: These terms and conditions may be modified, amended, or supplemented by the company at its sole discretion. Any modifications will be communicated to me in writing and will become effective as of the specified date. Penalty for Personal Financial Transactions: I understand and agree that under no circumstances am I allowed to engage in personal financial transactions or divert funds belonging to the company into my personal account without proper authorization. If it is found that I have taken money personally without informing the company, I acknowledge that I will be subject to penalties. Fine and Recovery: In the event of unauthorized personal financial transactions, I acknowledge that the company reserves the right to impose a fine as determined by the company. The fine may be equivalent to double the amount of money improperly taken from the company, and I agree to pay this fine promptly upon notification. Legal Expenses: In addition to the fine, I understand and accept that I will be liable for any legal expenses incurred by the company in recovering the funds and addressing the unauthorized personal financial transactions. These expenses may include attorney fees, court costs, and any other related costs. Cooperation in Recovery Efforts: If it is discovered that I have engaged in unauthorized personal financial transactions, I agree to fully cooperate with the company in its efforts to recover the misappropriated funds. This includes providing all necessary information and access to relevant accounts or records. Correct Legal Documentation: I confirm that all legal documentations provided to the company, including identification, educational certificates, and employment records, are accurate, valid, and up-to-date. I understand that providing false or misleading information may result in immediate termination of my employment and potential legal consequences. Updates to Legal Documentation: I will promptly notify the company of any changes or updates to my legal documentation, including but not limited to changes in my name, address, marital status, or any legal proceedings that may impact my employment or eligibility to work. Verification of Legal Documentation: The company reserves the right to verify and authenticate the legal documentation provided by me. I consent to the company conducting background checks, contacting relevant authorities, and taking any necessary steps to verify the authenticity and accuracy of the submitted documentation. Consequences of False Documentation: If it is discovered that any of the legal documentation I provided to the company is falsified, fabricated, or misleading, I understand that it may lead to immediate termination of my employment and potential legal actions. Non-Familial Engagement in Competitor Business: In addition to the non-compete agreement mentioned earlier, I agree that neither I nor any member of my immediate family will engage in employment, consultancy, or ownership of a competitive business entity with a similar nature of business as the company's for a period of five years after my departure or termination from the company. Acknowledgment of Competitive Nature: I understand and acknowledge that the nature of the company's business activities is competitive, and the restriction on engaging in similar business endeavors after leaving the company is necessary to protect its legitimate business interests. Scope of Competitive Business: The prohibition on joining competitive businesses includes entities that directly compete with the company in terms of products, services, or target markets. This includes companies operating in the same industry or offering similar goods or services that may be deemed as competition by the company. Non-Circumvention: I further agree that I will not attempt to circumvent this agreement by acting as an intermediary, consultant, or agent on behalf of a competitive business, or in any other capacity that could undermine the company's interests. Severability: If any provision of this agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. Modification of Terms: These terms and conditions, including the non-familial engagement in a competitor business clause, may be modified, amended, or supplemented by the company at its sole discretion. Any modifications will be communicated to me in writing and will become effective as of the specified date.
